Demotion Actions/Labor Issues

Overview

Demotion actions may follow some kind of misconduct or failure to adhere to military values or the Uniform Code of Military Justice (UCMJ). Your superior may request a rank demotion through a military justice process for such behavior as a DUI, drug crimes, dereliction of duty or some other offense.

The Uniformed Services Employment and Reemployment Rights Act of 1994 (SERRA) protects civilian job rights and benefits for veterans and members of Reserve components. It provides that returning service-members are reemployed in the job that they would have attained had they not been absent for military service, with the same seniority, status and pay, as well as other rights and benefits determined by seniority.
